For those unaware of what's going on in the CBD world (or what CBD is!) let's do a deep dive:

First, What is CBD? ..And why are we putting it into Beauty Products?

I think most of us know what CBD is in 2021, but just in case, let’s do a crash course.

CBD (cannabidiol) is "a non-psychoactive compound in cannabis that is believed to have a variety of medical uses (easing pain and anxiety and soothing irritated skin, among other things) and does not cause a marijuana high" (source).

In other words - skincare and cosmetic terms - CBD is an anti-inflammatory in an oil form. This makes it conducive for a range of products and especially beneficial for products meant to fight inflammation. Sufferers of acne, rosacea, psoriasis or eczema may find CBD to be extremely beneficial!

CBD Benefits

  • reducing inflammation (CBD’s main game)

  • immunity-boosting

  • sleep

  • mood

  • dry skin (although CBG really takes the cake here)

  • anxiety (perhaps)

Additionally, CBD suspended in a carrier oil can be used as a substitute for other animal-derived oils and animal by-products, thereby making the formulas now vegan. Win-win! CBD is the green and clean choice then - pun fully intended.

What about CBD Regulation?

While the FDA takes a moderately hard stance on claims of skincare and beauty products NOT being drugs (e.g. you cannot label your skincare as one that helps with eczema, as this is a medical claim), CBD has been in the news so much lately that its benefits are already widely known. You don't even have to make claims if the media is making them for you.

Here's where the FDA stands:

"The FDA has made it clear that CBD products cannot be sold as dietary supplements because CBD is “authorized for investigation as a new drug,” a classification that disallows products from being sold as dietary supplements while under clinical investigation." 

However, unlike marijuana, hemp-derived CBD is technically legal in all 50 states because "it contains only trace amounts of THC”.. “and it’s becoming a hugely popular ingredient in the beauty world, thanks to its prevalence of vitamin E, omega fatty acids and chill vibes." (source)

For now CBD regulation is up to the states - if they even want to regulate it. Most states have remained silent or have chosen not to make CBD illegal (including Indiana, where our lab is located - a traditionally ultra-conservative state;

update: Indiana has since made legislation allowing for CBD, as long as brands abide by their labeling guide.). There are some legalities when it comes to labeling, but we will send you a list and review these together before you print packaging or sell your products.

Here are some other CBD Regulation Tips:

  • Although regulation is sparse, stay up-to-date. You never know when things can change.

  • Check your state and local ordinances to make sure you're complying. Most states do have some regulation around marketing your CBD products.

  • Speak with your lawyer about what labeling or other local or federal requirements you may need to follow.

 

What about CBD + THC in Makeup and Skincare?

In states where recreational use of marijuana is legal, you may see THC in both makeup and skincare products, as well as CBD. However, as of now, THC is not legal in most states, nor is it legal federally.

You may only sell THC-infused products locally in states where recreational marijuana is approved, and even then, the federal government can always step in and shut your operations down if they choose.

At this point in time, we recommend sticking with CBD products instead. If and when marijuana use is made legal federally, we will revisit the topic here on the blog! And hell yes, we’ll be making THC skincare when it’s federally legal.



What’s the difference between Full Spectrum CBD, Broad Spectrum CBD and CBD Isolate?

Some companies (like Sephora) no longer allow isolated CBD; they only allow full spectrum and broad spectrum CBD - so this somewhat speaks to the public sentiment (even if not yet totally research backed) around full spectrum vs broad spectrum vs isolate.

Or perhaps they are trying to get ahead of the FDA, thinking they will make isolated CBD a drug, given all the Phase 2 and 3 skincare trials going on now for CBD products for acne. Who knows!

In any case, let’s dive into the differences, since it can be a little confusing:

Full Spectrum CBD

  • Thought of as the “full plant” or “full plant extract”

  • It is the hemp extract containing CBD, THC, other cannabinoids and terpenes (though the THC is usually in trace amounts)

    Pros:

  • Desired by many consumers because they believe it works better, when the “full plant can do its full job”.

  • Research is limited, but anecdotal evidence abounds. It helps pain, the people say!

    Cons:

  • The THC level may be too high to be legal, and full spectrum CBD often smells very hemp-y or like marijuana.

  • It smells like weed.

  • It ranges from brown to dark green, so it may make your skincare or color cosmetics an unpleasant color.

  • Formulae can only hold so much of it.

  • Not all retailers want or will accept FS CBD.


In short, full spectrum CBD is best for pain relieving products. Here’s a few of our products to keep in mind.

Broad Spectrum CBD

  • Contains the CBD, minor cannabinoids (in most instances) and sometimes terpenes, but no detectable THC.

  • Can range from very light profiles (high CBD, almost nothing else) to heavy minor profiles (moderate CBD to moderate cannabinoids).

Pros:

  • Great alternative to full spectrum (you get all of the benefits with none of the drawbacks).

  • Less weed smell than Full Spectrum

  • You CAN get ALL the cannabinoids! It can be a fun, entourage effect party for the skin.

Cons:

  • Warning: not all broad spectrum CBD is made alike. It may contain only one terpenes and no detectable amount of cannabinoids.

  • The weed smell can still turn some away and can be difficult to cover.

  • Can still have a dark color, but you need a lot less of BS distillate, so your product may just be a beige color.

  • Not always stable; there’s a limit to achievable and stable CBD concentration, though it’s higher than in full spectrum formulae.

Some use the terms “broad spectrum” and “THC-free CBD” synonymously, when technically CBD isolate is also “THC-Free CBD”… because it’s CBD without THC, but it contains none of the other terpenes or minors to work together with is.

To confirm the amount of minors and terpenes, ask your lab to coordinate for 3rd party minor and terpene testing ($). They may also have higher minor cannabinoid-based broad spectrum CBD.

Basically, broad spectrum CBD means you want the whole entourage and benefits without all the smell and color. Anti-aging skincare is the best use. Here are some more CBD skincare products.

Isolated CBD

  • Just CBD. Typically 99-100% pure.

  • Typically winterized and removed from the crude hemp extract.

Pros:

  • Colorless, scentless

  • Can be used in a wide variety of products at high concentrations with no detectable smell, feel or color.

  • Great for acne

Cons:

  • However, users report (again, this is anecdotal evidence) that isolated CBD does not work as well for pain and inflammation as full spectrum CBD.

  • Not very stable / oxidizes quickly. Be careful and formulate holistically!

  • Not all retailers accept CBD isolate.

Major retails like Sephora (owned by LVMH) only (now) allow the sale of broad and full spectrum CBD beauty products, so those are the hottest types of products to create in 2020 and beyond. Expect the price per unit to be higher on the manufacturing side, but the price you can charge on the retail side will also be higher.


To sum up, isolate means isolated CBD. You’ll also find water-based products need to be isolate due to their formulas (or even water-soluble isolate, depending on the formula). Look below for some of our isolate products.

Tell me more about minor cannabinoids - What about CBG, CBN and other cannabinoids?

Update: As of January 2021, most of our broad spectrum CBD products are made with high minor, luxury minor cannabinoid profiles.

As research comes out about other cannabinoids (sometimes called minor cannabinoids or “minors”), consumers are asking more and more for these minor cannabinoids in their beauty products. Often, consumers want the cannabinoids working together with terpenes, without the THC, because of drug tests or other legal or medical issues.

So far, research is limited, but early research points to the use of CBG and CBGV for ant-aging products (i.e. they target top-layer inflammation and dryness (sourceoriginal source)) whereas CBC and CBDV are best used for acne. BUT, remember, "all phytocannabinoids exhibit remarkable anti-inflammatory actions", so you always have that to look forward to.

We are releasing a target minors catalog soon, but in the meantime, ask your rep at Genie Supply about products with high minor profiles or isolated minors. As of 2021, most of our broad spectrum CBD products are made with high minor, luxury minor cannabinoid profiles to compete with (read: blow out of the water) the best of the best brands. Not just CBD brands. Brands. Period.

CBD Cosmetics vs. CBD Skincare - What's the Difference?

There's a big difference between dietary supplements and cosmetics, though all are regulated by the FDA.

When we talk about cosmetics and skincare, both are made to enhance the appearance of the user, are NOT medicines or drugs, and CANNOT make claims about what they can do to change the structure or function of the body.

 

How Can I Prepare for my CBD Skincare / Cosmetics company?

Hemp Seed oil (cannabis sativa seed oil) is fine for use in cosmetics in the United States with no issues, but one should just follow INCI labeling. 

CBD, however, should be labeled as “Cannabidiol” or “Hemp Extract”. Again, follow all local and state laws regarding CBD and CBD labeling. Please be aware that CBD/cannabis is a volatile industry and the regulations may change overnight. 

Here's some tips we have, to prepare yourself:

  • Follow all existing FDA packaging and labeling requirements. Label following INCI names and FDA labeling rules (more on that here, where we’ve broken it down easily for you - thank us later).

  • Stay flexible with inventory, manufacturers and vendors.

  • Keep batches relatively small unless you have existing distribution channels.

  • Go local! CBD may be more accepted at local dispensaries and shops in your state than others, so keep it local and wholesale quickly.

  • Stay up to date on CBD legislation changes in your state and country. Retain a lawyer that specializes in CBD products.

  • Legislation can change, so please be careful and stay on top of your state laws!
